EAEU Commission Initiated a Discussion Over Changes for TR CU 005 On Safety of Packaging
EAEU Commission has initiated a public discussion of new amendments to TR CU 005/2011 "On safety of packaging" on July 15, 2020.
The revision of the regulation involves bringing its provisions in accordance with the standards of the Protocol on Technical Regulation in the Eurasian Economic Union (EAEU) (Appendix No. 9 to the Treaty on the EAEU of May 29, 2014).
Other changes relate to the revision of the applied declaration schemes for compliance with the conformity assessment schemes, which were adopted by the decision of the Council of the Eurasian Economic Commission (EEC) No. 44 dated April 18, 2018. Article 7 of the Regulation containing provisions on conformity assessment is fully set out in the new edition. At the same time, the acceptable schemes for registering the declaration, in essence, remained the same:
- 3d, 4d, 6d - for packaging for food, perfumery and cosmetic products that have direct contact with packaged products, toys and baby products that come into contact with the child's mouth;
- 1d, 2d - for other packaging.
The changes imply the inclusion of clear storage periods for evidentiary materials and the packaging declaration itself:
- for the applicant - at least 10 years from the date of termination of the production of serial supplies or the sale of the last product from the batch;
- for a certification body - at least 5 years from the expiration date of the declaration or at least 10 years from the date of registration of the declaration without a validity period.
The changes clarify the rules for the release into circulation of packaging and closures. Thus, the regulations will clearly state the obligation to label the packaging with the EAC mark that have passed the mandatory compliance process with its requirements.
The public discussion is expected to be finished on September 24, 2020.
