Amendments to EAC TR CU 009/2011 "On the Safety of Perfumery and Cosmetic Products"
The requirements for the composition of perfumes and cosmetics for EAC countries have been clarified. Thus, the lists of substances prohibited or permitted for use have been updated, as well as lists of permitted dyes, preservatives and UV filters, taking into account the established restrictions. The requirements are aligned with the EU Cosmetics Regulation (EC) No 1223/2009.
Separate groups of cosmetic goods for which microbiological indicators are not determined have also been identified. These are nail varnishes, oxidative hair dyes, hair removal products and other products.
General criteria for the validity of statements regarding the consumer properties of perfumes and cosmetics are introduced. Now, for example, statements that declare the absence of substances prohibited for use in cosmetics are not allowed. Statements about the properties of an ingredient should not unreasonably extend to product properties. In addition, they should not include information on approval by executive authorities, etc.
A number of standards on conformity assessment have been clarified, including the new type schemes adopted by the Council of the Eurasian Economic Commission in April 2018.
Namely, the list of documents that the applicant must submit for registration of the declaration and the storage period for these documents in an accredited or authorized body have been determined. There are cases when it is allowed to accept a declaration of conformity without additional tests, for example, when changing the contact details of the applicant or the HS code (customs tariff number).
In July 2019, the EEC Board established transitional provisions on the entry into force of amendments to the technical regulation of the Union “On the safety of perfumes and cosmetics” TR CU 009/2011, providing for a gradual transition to new requirements. Thus, conformity confirmation documents, adopted before May 5, 2020, are valid until the expiration of their validity. Documents on State Registration issued also before May 5, 2020, are valid until May 5, 2023.
At the same time, production and putting into circulation on the EAEU (EAC) market of products in the presence of such documents on conformity assessment are allowed until their expiration.
