Russia simplifies EAC and GOST certification procedures
On March 14, 2022, Decree of the Government of the Russian Federation No. 353 "On the specifics of licensing activities in the Russian Federation in 2022" came into force.
The aim is to make certification procedure smother for foreign manufactures. All changes work only on the territory of the Russian Federation, not the whole Customs Union. The decision was introduced due to sanctions restrictions.
The main issues which you should know from the Decree are listed below:
1. EAC and GOST certification procedures can be simplified
During this period, public authorities will be able to make decisions on reducing the mandatory requirements or the list of documents provided for certification, on canceling the assessment of compliance with mandatory requirements.
2. The period of validity of documents on conformity assessment is extended
Conformity assessment documents that expire between March 14, 2022 and September 01, 2022 are automatically extended for 12 months without the need to re-assess the conformity of products produced and (or) released in circulation only on the territory of the Russian Federation. EAC mark should not be put on such products.
3. It is allowed not to label products with EAC mark for customs clearance
Until March 01, 2023, it is allowed to import products into the Russian Federation without marking with an EAC logo. This applies only to products intended for circulation in the territory of the Russian Federation. In this case, EAC mark should be put on the product before the sale of such products to customers already on the territory of the Russian Federation.
4. Products which do not require certificates and declarations of conformity
Clause 4 establishes the types of products for which it is not required to provide documents on conformity assessment and even information about such documents when imported into the territory of the Russian Federation (spare parts, accessories, components, raw materials, etc.).
5. Russia Customs does not require original conformity assessment documents
Confirmation of compliance is carried out by submitting information of documents (number of certificate or declaration) to the Customs Authorities, without providing original documents.
6. Certification can be replaced by declaration
Certification and declaration (based on tests carried out by an accredited testing laboratory) can be replaced by declaration based on the applicant's own evidences from March 21, 2022, to September 1, 2022 for a certain list of products imported into the territory of the Russian Federation. Such declarations can only be issued for a batch or a single product with a validity period of 6 months from the date of registration.
The list of products for which such a replacement of conformity assessment forms is not applicable:
- Pyrotechnic products and explosives;
- Elevators and lift equipment; Some machines and equipment:
- Snow and swamp vehicles, snowmobiles and trailers for them;
- Agricultural machines;
- Machines for animal husbandry, poultry farming and fodder production;
- Lifting and transport equipment;
- Tractors, tractor trailers and components for them;
- Weapons and ammunition;
- Heating radiators and convectors;
- Cement;
- Pesticides;
- Breathing equipment and gas masks;
- Polyethylene pipes for transporting gaseous fuels;
- Goods, clothes and linen for children.
Products for which a “simplified” declaration is issued are not marked with EAC logo, and can only be put into circulation on the territory of the Russian Federation.
7. It is allowed to take samples for testing from an already imported batch of products
Sampling for the purposes of certification or declaration of conformity on the basis of evidence obtained with the participation of an accredited laboratory can be carried out from a batch of products that was imported according to a “simplified” declaration of conformity (cl. 6) issued for a batch of products for a period of validity of 6 months.
8. GLNs are optional
Until March 1, 2023, certificates of conformity and declarations of conformity do not have to indicate the GLN, geographical coordinates or other manufacturer's location identifier. The indication of these data is carried out at the choice of the applicant, if possible.
9. SGR
State bodies have the right, taking into account the specifics of the types of licensing activities, to reduce the execution period for SGR, extend the period of validity, reduce the list of documents for registration, etc. Such goods, for example, include personal hygiene items for adults.
Decree of the Government of the Russian Federation No. 353 dated on March 12, 2022 doesn’t cancel the conformity assessment procedure in EAEU countries. This document gives some relief when importing products into the territory of the Russian Federation.
Note, that all these changes are in the process of being introduced. It will take some time to make them work. Certification bodies and experts are waiting for clarifications from Rosakkreditatsiya how exactly all these changes will work.
