Recommendations of the Federal Customs Service of Russia about samples for testing (EAC)
Federal Customs Service of Russia and Federal Service for Accreditation have developed the recommendations for carrying out customs operations related to the importation of goods into the Russian Federation as samples and specimens for the purpose of conducting research and testing of products are developed in accordance with the law of the Eurasian Economic Union.
Analysis of law enforcement practice showed that not all economic entities properly enforce the rights of the EAEU and the legislation of the Russian Federation when importing controlled goods for research and testing.
One of the goals for the requirements is to prevent violations of mandatory requirements of the Federal Law No. 294-FZ dated December 26, 2008 “On the Protection of the Rights of Legal Entities “.
The authorities have specified the list of documents that certification bodies and testing laboratories are held accounted for when processing the certification procedures. In cases of absence of such documents in certification bodies and testing laboratories, the information will be transmitted to the Federal Customs Service of Russia to consider taking measures on the facts of non-compliance with the procedure for importing goods into the Russian Federation.
The recommendations also indicate that when conducting research and measurements in order to assess compliance, it is necessary to use samples of products that are to be released into circulation in the Russian Federation, and therefore previously imported products cannot serve as samples of products that are to be imported for subsequent release into circulation.
