What changes are we expecting in EAC Certification in 2022?
On November 26, 2021 the public discussion of the draft amendments to the Decision of the Board of the Eurasian Economic Commission (EEC) № 293 of December 25, 2012 began.
The public discussion will last 45 days and is due to finish on January 10, 2022.
What are the aims:
- Simplify procedures of making amendments in registered EAC Certificates and Declarations of conformity when it is required to make changes in them that do not affect product safety.
- Minimize risks of importing products to the territory of the EACU that do not comply with mandatory EAC requirements.
- Simplify the traceability of products for end consumers.
1. Electronic EAC Certificates and EAC Declarations may appear
First of all, important changes include the question of electronic permits. Electronic record of an EAC Certificate or EAC Declaration in the unified register may become an equivalent of an electronic form of EAC Certificate or EAC Declaration. Such documents are supposed to have equal legal force with hard copy of EAC documents.
It is important that in case of contradiction of information in electronic and hard copy of EAC document the preference is given to the electronic document.
In this regard, it will be allowed to execute EAC approval documents only in an electronic form without issuing a hard copy. In such case, a note is made in the unified register that the document was not issued in the form of hard paper, and it is impossible to get its hard copy version.
It will considerably help manufactures and importers and there will be no need to replace the hard copy of EAC document, for example, in case of its loss.
2. How to replace EAC Certificate or Declaration?
The draft amendments to the Decision № 293 states that the replacement of the certificate and declaration of conformity is carried out in accordance with the standard schemes approved by EACU Council Decision No. 44 of 18 April 2018, where the cases of "easy" reissue of permits without conducting additional research are listed.
It is also planned to include an important clarification that in the case of replacement of EAC Certificate or EAC Declaration and their annexes, the circulation of products is not suspended for the time required for such replacement.
3. QR codes in the forms of EAC Certificates and EAC Declarations
QR codes will be added on the hard copies of EAC Certificate or EAC Declaration, which will allow a quick transition to electronic versions of documents in the unified registry.
This will help to check actual status of an EAC document quickly.
4. Additional fields will be added in EAC Certificates and EAC Declarations.
EAC Certificates for serial production will cover products manufactured after the production date of the test sample. This date will be indicated in EAC Certificates.
EAC Declaration will include information on the contract between manufacturer and EAC local representative company (EAC applicant). Such contract ensures the compliance of products supplied to the EAEU territory with the TR CU requirements and liability for non-compliance.
