TR CU 010/2011 "On the safety of machinery and equipment” will allow using scheme 7d
On March 26, 2021, as part of the regulatory impact assessment, a discussion of draft amendments to the technical regulation TR CU 010 "On the Safety of Machinery and Equipment" was launched on the Federal Portal of Draft Regulatory Acts.
Completion of the procedure is scheduled for April 22.
The draft decision of the EEC Council on amendments, containing the annex with the proposed amendments, has been sent for discussion. These amendments will enter into force provided that they are adopted 6 months after their official publication.
The procedure for public discussion of the draft amendments to TR CU 010/2011 took place from January 27 to May 10, 2020 (initially, the procedure was planned to be completed on April 10). Currently, the process of internal approval of the document continues.
The main purpose of the amendments to the equipment regulations discussed in the Union is to update the provisions concerning the conformity assessment of machinery and equipment. In particular, the amendments give the clarification of certain points such as:
- The establishment of forms, schemes and procedures for conformity assessment based on the so-called new standard conformity assessment schemes (decision of the EEC Council No. 44 of April 18, 2018);
- Implementation of the declaration of conformity procedure under scheme 7d;
- Bringing the provisions of the regulation in line with the Protocol on Technical Regulation in the EAEU in terms of conformity assessment.
Regarding scheme 7d, we note that according to the draft amendments, scheme 7d, as well as 5d, are used under certain conditions: the use of machinery or equipment at hazardous production facilities, the inability to carry out tests in full before installation at the site of operation, the applicant's failure to apply standards from the list of voluntary ones (for example, it may be innovative equipment for which standards have not yet been put into effect). Scheme 7d is intended for the release into circulation of a batch or a single product. It is applied on the basis of its own evidence and evidence obtained with the help of a certification body and an accredited testing laboratory, if necessary.
