Conclusion of Absence of Encryption (Cryptographic) Capabilities for the Customs Union | FSS Russia
Products that are in the list of items that are subject to FSS Notification do not always have encryption capabilities. In this case, such product doesn’t need to receive FSS Notification or FSS Exemption Letter to be exported to the countries of the Customs Union, but instead it is recommended, that it receives Conclusion of Absence of Encryption.
During the customs clearance, an officer may request FSS Notification or FSS Exemption letter when a product with an HS code from the list is exported to the Customs Union. If a product doesn’t have any encryption functions, Conclusion of Absence of Encryption can be used to successfully pass the customs clearance.
Conclusion of Absence of Encryption is a document issued by an accredited certification body, which declares that a product doesn’t have any encryption functions and therefore it is not subject to FSS Notification.
Some of the products that are subject to FSS Notification, but don’t use encryption include: industrial controllers, signal repeaters, microprocessors without hardware implementation of cryptographic algorithms and media converters. Conclusion of Absence of Encryption is recommended to be obtained for these products.
The procedure of obtaining the Conclusion is similar to obtaining an FSS document and takes 7 working days to prepare it.
